WHEREAS:
A growing number of employers are using performance testing as a substitute, or in addition to, drug-and alcohol testing; and
WHEREAS:
Performance testing claims to determine an employee's ability or inability to perform job duties without regard to the cause for any inability; and
WHEREAS:
Performance testing operates like a video game, lasts less than a minute, and measures the ability to perform tasks requiring fine hand-eye coordination and quick reaction time; and
WHEREAS:
Performance testing involves many of the same issues as drug and alcohol testing, such as appropriateness, due process, accuracy and relevancy of testing methods, and consequences for employees.
THEREFORE BE IT RESOLVED:
Performance testing is properly a subject for negotiations and AFSCME will resist attempts to mandate or impose performance testing on employees without the union's participation and consent; and
BE IT FURTHER RESOLVED:
Performance testing should be limited to occupations where unimpaired hand-eye coordination is a requirement for safe job performance and there is reasonable suspicion of impairment; and
BE IT FINALLY RESOLVED:
Where performance testing is used, AFSCME will demand provisions to prevent the misuse or abuse of such tests and to protect employees' rights.
